These General Terms and Conditions govern access to and use of the website, as well as the purchase of products and, where applicable, services offered through www.ipontennis.com, owned by Ipontennis, S.L.

2. Purpose and scope
These Terms govern the purchase of products and, where applicable, the purchase of services offered by Ipontennis through its online store.
Use of the website and/or the placing of an order gives the user or customer that status and implies full and unconditional acceptance of these General Terms and Conditions, the Legal Notice, the Privacy Policy and the Cookie Policy, in the versions in force at the time the contract is concluded.
If you do not agree with any of these legal texts, you should not use this website or place orders through it.
3. Access and purchase conditions
To place an order on www.ipontennis.com, the user must be of legal age and have sufficient legal capacity to enter into a contract.
The customer undertakes to provide truthful, accurate and up-to-date information during the purchasing process. If the customer provides incorrect, incomplete or outdated information, Ipontennis will not be responsible for delays or inability to deliver resulting from that circumstance.
By placing an order, the customer declares that they are authorised to use the selected payment method and that the information provided for the purchase is correct.
4. Ordering process
To place an order, the customer must follow the online purchasing process available on the website: selecting the desired products or services, adding them to the cart, entering the required information and finally confirming the purchase using the button provided for that purpose, which entails an obligation to pay.
Before completing the order, the customer may review the selected products, identify and correct any data-entry errors and check the full final price, including taxes and, where applicable, shipping charges or other additional costs.
Once the order has been placed, the customer will receive an email confirming receipt of the order. This communication does not constitute final acceptance of the order; it only confirms that the order has been received.
The sales contract is concluded when Ipontennis sends the customer an express confirmation of acceptance and/or dispatch of the order by email or another equivalent durable medium.
5. Products and availability
Ipontennis sells products related to tennis, padel and other related sports, including tennis rackets, padel rackets, footwear, racket bags, backpacks, accessories, court equipment and complementary products.
Ipontennis may also offer accessory or personalised services such as stringing, assembly, product configuration, customisation or adjustment to the customer's specifications.
All orders are subject to actual stock availability.
If, after an order has been placed, a product is wholly or partially unavailable, Ipontennis will inform the customer as soon as possible and, as appropriate, offer an alternative solution, a new estimated timeframe or a refund of the amount paid for the unavailable product.
6. Prices
All prices shown on the website are expressed in euros and include the legally applicable taxes unless expressly stated otherwise.
Shipping charges and any other additional costs associated with the order will be itemised for the customer before the purchasing process is completed.
Ipontennis reserves the right to change the prices published on the website at any time. However, products will be invoiced at the prices in force when the order is actually placed, except in the event of an obvious material error.
7. Payment methods
The customer may pay for the order using the payment methods available during checkout at the relevant time.
Ipontennis reserves the right to change, add or restrict the available payment methods for technical, operational, security or fraud-prevention reasons.
Payments may be processed through secure payment gateways managed by specialist third-party providers. Bank or card details are processed directly by those providers in accordance with their own security standards.
Ipontennis may carry out additional identity or security checks before accepting an order where there are objective indications of fraud or unauthorised use of the payment method.
8. Delivery
Orders will be delivered to the address provided by the customer during checkout, within the geographical areas available from Ipontennis at the relevant time.
Delivery times shown on the website, product page, cart or during checkout are estimates unless expressly stated otherwise.
Unless otherwise agreed or a different specific timeframe is stated, delivery will be made without undue delay and, in any event, within the maximum period required by applicable law from the conclusion of the contract.
Ipontennis will not be responsible for inability to deliver where the information provided by the customer is incorrect or incomplete, or where delivery is prevented by circumstances outside Ipontennis's reasonable control.
9. Right of withdrawal
Summary: where the purchaser qualifies as a consumer or user, they generally have 14 calendar days to withdraw from the purchase without giving any reason.
The withdrawal period expires 14 calendar days after the day on which the consumer, or a third party indicated by the consumer other than the carrier, takes physical possession of the goods.
To exercise the right of withdrawal, the customer must communicate an unequivocal decision to Ipontennis by email to info@ipontennis.com or in writing to the postal address stated in these Terms.
The customer may use the model withdrawal form included at the end of this document, although use of the form is not compulsory.
10. Consequences of withdrawal
In the event of a valid withdrawal, Ipontennis will refund all payments received from the customer, including, where applicable, the delivery charges corresponding to the least expensive standard delivery method offered, without undue delay and, in any event, no later than 14 calendar days from the date on which Ipontennis is informed of the decision to withdraw.
Ipontennis may withhold the refund until the returned goods have been received or until the customer has provided sufficient evidence of having sent them back, whichever occurs first.
The refund will be made using the same payment method used by the customer for the original transaction, unless the customer has expressly agreed otherwise and provided that this does not result in any additional cost.
The customer must return the products without undue delay and, in any event, no later than 14 calendar days from the date on which they communicated their decision to withdraw.
Unless Ipontennis expressly states otherwise, the customer will bear the direct cost of the return where it results from withdrawal and not from an error, incident or lack of conformity attributable to Ipontennis.
The customer will only be responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
11. Exceptions to the right of withdrawal
Important: the right of withdrawal does not apply to certain personalised products or services carried out to the customer's specifications where a legal exception applies.
In accordance with applicable law, the right of withdrawal will not apply, among other circumstances provided for by law, to:
- Products made to the consumer's specifications or clearly personalised.
- Services that have already been performed or fully provided where the applicable legal exception applies.
- Sealed goods that are not suitable for return for health-protection or hygiene reasons and that have been unsealed after delivery.
- Products which, by their nature, become inseparably mixed with other goods after delivery.
At Ipontennis, these exceptions may apply, among other things, to stringing services that have already been performed, personalised products or made-to-order items configured according to the customer's instructions.
12. Returns due to error, damage or lack of conformity
If the customer considers that the product received does not conform to the contract, has arrived damaged, is incorrect or has an original defect, they should notify Ipontennis as soon as possible by emailing info@ipontennis.com, stating the order number, details of the affected product and a detailed description of the issue.
Ipontennis may request photographs, videos or other reasonable information that helps verify the issue and process the appropriate solution.
Where required by law, Ipontennis will offer the customer repair, replacement, a price reduction or termination of the contract, in accordance with applicable law.
13. Legal guarantee
All products sold to consumers and users are covered by the statutory guarantee of conformity under the terms provided for by applicable law.
Ipontennis will be liable to the consumer for any lack of conformity that exists at the time of delivery and becomes apparent within the applicable statutory period.
The legal guarantee does not cover damage caused by misuse, impacts, normal wear and tear, incorrect handling, inadequate maintenance, improper storage, use contrary to the manufacturer's instructions, or repairs or modifications carried out by unauthorised third parties.
To process a guarantee claim, the customer should contact Ipontennis at info@ipontennis.com and provide, as far as possible, the order number or invoice, a description of the problem and any documentation, photographs or other material that may help assess the issue.
14. Liability
Ipontennis endeavours to ensure that product descriptions, photographs, images, technical specifications, prices and other product information are as accurate and up to date as possible. However, this information may contain typographical errors or minor non-essential inaccuracies.
Ipontennis will not be responsible for damage or loss resulting from interference, interruptions, computer viruses, telephone failures, operational disconnections of electronic systems, delays or blockages caused by deficiencies or overloads outside its reasonable control.
Nothing in these Terms limits the rights granted to consumers and users under mandatory applicable law.
15. Intellectual and industrial property
All website content, including text, images, photographs, logos, designs, icons, videos, software, structure, layout and other elements, is owned by Ipontennis or by third parties who have authorised its use and is protected by applicable intellectual and industrial property law.
Reproduction, distribution, public communication, transformation, extraction, reuse or total or partial exploitation of this content without the prior express written authorisation of the relevant rights holder is prohibited, except where permitted by law.
16. Personal data protection
Personal data provided during the purchasing process or through use of the website will be processed in accordance with the Privacy Policy and applicable data-protection law.
18. Electronic communications
The customer accepts that communications, notifications, invoices, confirmations and other contractual documentation may be sent electronically where permitted by applicable law.
For contractual purposes, the customer consents to the use of email and acknowledges that electronic communications satisfy the applicable legal requirements where appropriate.

20. Severability
If any provision of these Terms is declared void, invalid or unenforceable, this will not affect the validity of the remaining provisions, which will remain in force to the extent that they are unaffected.
21. Amendments to these Terms
Ipontennis reserves the right to amend these General Terms and Conditions where necessary because of regulatory, technical, commercial or operational changes to the website.
In all cases, the terms and conditions in force when the order is placed will apply to that order.
22. Governing law and jurisdiction
These General Terms and Conditions are governed by Spanish law.
In the event of any dispute arising from the interpretation, performance or validity of these Terms, the courts and tribunals determined in accordance with applicable law will have jurisdiction.
Where the customer qualifies as a consumer or user, the courts and tribunals of the customer's place of residence will have jurisdiction under the terms provided for by law.
